This Privacy Policy explains how MarketerZ, a French AI agency, collects, uses, and protects your personal data, whether you are browsing our website or using an artificial intelligence solution we built for one of our clients. It follows the requirements of the GDPR (General Data Protection Regulation).

When you use a solution MarketerZ built for one of our clients (a virtual assistant, an AI phone bot, an enterprise AI agent), that client remains the data controller for its own users' data. MarketerZ then acts as a data processor, under a GDPR-compliant data processing agreement.

Data We Collect

We only collect the data needed to run our website and deliver our services. What we collect depends on the context: browsing our site, reaching out to us, or using an AI solution we built for a client.

Data you give us directly

  • Full name
  • Email address
  • Phone number
  • Postal or business address
  • Company and job title, when relevant
  • Anything else you share through our contact forms or our Calendly booking page

Data collected automatically

  • IP address
  • Browsing data (pages visited, time on site, browser type)
  • Cookies and trackers, detailed in our Cookie Policy

Data processed on behalf of our clients

When you interact with a virtual assistant, an AI phone bot, or an enterprise AI agent we built for one of our clients, we may process your conversations (messages, call transcripts) and any documents you submit (photos, invoices, quotes, contracts) on that client's behalf. This data stays under the responsibility of the client concerned, who decides its purpose and how long it is kept.

Purposes and Legal Basis

We use the data collected on our site for the following purposes:

  • Responding to your requests for information, quotes, or meetings, based on pre-contractual steps or our legitimate interest
  • Sending you commercial communications, only with your prior consent
  • Improving our site and content, through anonymized audience measurement, based on our legitimate interest
  • Meeting our legal and accounting obligations, based on a legal obligation
  • Preventing fraud and keeping our systems secure, based on our legitimate interest

Within the solutions we deploy for clients, processing relies on the legal basis defined by the client acting as data controller: most often the performance of your contract with them, or their legitimate interest in handling your request.

Retention Periods

  • Prospects and customers: 3 years after the last contact
  • Contractual and accounting records: 10 years, as required by law
  • Cookies and browsing data: up to 13 months
  • Job applications: 2 years after submission
  • Data processed on behalf of a client (AI agent, virtual assistant, phone bot): the period set by that client, in line with its own legal obligations

Once these periods end, data is deleted or anonymized.

Your GDPR Rights

Under the GDPR, you have the following rights over your personal data:

  • Right of access: obtain information about the data we hold about you
  • Right to rectification: request correction of inaccurate or incomplete data
  • Right to erasure ("right to be forgotten"): request deletion of your data, under certain conditions
  • Right to restrict processing: temporarily limit how we use your data
  • Right to object: object to the use of your data for direct marketing
  • Right to data portability: receive your data in a structured format to pass on to a third party
  • Right to withdraw consent: withdraw your consent at any time when processing relies on it

You can exercise these personal data access rights by writing to contact@marketerz.fr or through our contact page. We respond within the one-month period required by law. You can also file a complaint with France's data protection authority, the CNIL, at www.cnil.fr.

If your data is processed as part of a solution we built for one of our clients, please reach out to that client first, since they are the data controller. MarketerZ forwards any request it receives by mistake to the right client.

Security and Hosting at MarketerZ

Protecting your data is a priority, both on our website and in the solutions we build. We put appropriate technical and organizational measures in place:

  • Encryption of sensitive data
  • Strict access controls, limited to authorized staff
  • Protection against cyberattacks (firewalls, antivirus)
  • Anonymization of conversations whenever possible
  • Your data is never used to train third-party AI models

Hosting You Choose

The solutions we build can be hosted, depending on what the client chooses, in the cloud (with European infrastructure favored where available) or directly on the client's own servers, on-premise. Our website itself is hosted by OVH, 2 rue Kellermann, 59100 Roubaix, France.

Transfers Outside the European Union

Some of the providers we rely on to run our website or our conversational assistance tools may be located outside the European Union. When that happens, MarketerZ puts appropriate safeguards in place, including the Standard Contractual Clauses approved by the European Commission.

Updates to This Policy
